Understanding Lawful Presence and Tuition Eligibility
These terms are often confusing, but they are not the same thing.

| Refers to whether an individual has authorization to be present in the United States under federal immigration law. | Refers to whether a student qualifies for an in-district, in-state, or out-of-state tuition rate under applicable law. |
| Determined under federal immigration law. | Determined under the laws governing tuition classification for Illinois community colleges. |
| Does not automatically determine a student's tuition rate. | Requires the College to review documentation using current legal requirements. |
Important: Having lawful presence does not automatically mean a student qualifies for an in-state or in-district tuition rate.
